These Terms and Conditions (“Terms”) govern your use of the Property Calculator Australia Pty Ltd (ACN 162 802 486, ABN 89 162 802 486) mobile application and website (together, the “Service”), operated by Property Calculator Australia Pty Ltd (“PCAU”, “we”, “us”, “our”), of PO Box 3348, Lansvale NSW 2166.

By using the Service, you agree to these Terms, our Privacy Policy and our Disclaimer. If you do not agree, please do not use the Service. Part A applies to all users. Part B applies in addition to professionals who register for the PCAU marketplace.

Part A
Terms for all users

1. Using the Service

We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the app, and to use the website, for your own personal, non-commercial use, in accordance with these Terms. Part B governs professional use of the marketplace.

2. Your account

Some features require an account. You are responsible for keeping your login details secure and for activity under your account. Tell us promptly if you believe your account has been accessed without your permission. You must provide accurate information and keep it up to date.

3. The calculators are estimates only

The calculators provide general information and estimates only, based on the figures you enter and rates and charges current at the time. They are not financial, credit, tax or legal advice, and they are not a loan offer, quote or guarantee. You should confirm any figure and seek advice from a licensed professional before relying on it. Our Disclaimer sets this out in full and forms part of these Terms.

4. Subscriptions and payment

PCAU offers the following access tiers:

Premium and Pro subscriptions are purchased and billed through the Apple App Store or Google Play, and are subject to the store’s terms as well as these Terms. Subscriptions renew automatically each period unless cancelled. You manage, cancel or change your subscription through your app-store account; cancellation takes effect at the end of the current billing period. Refunds for store-billed subscriptions are handled under the relevant store’s policies. Lead access for professionals is billed separately and is governed by Part B. Prices and tier features may change; we will give reasonable notice of material changes.

These Terms are between you and PCAU only, and not with Apple or Google. The relevant app store is not responsible for the app or its content and is not a party to these Terms. Where the app store’s rules require, the app store and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you, and your use of the app must also comply with the app store’s own terms.

Nothing in these Terms excludes any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

5. Connecting with a professional

If you choose to connect with a professional, you consent to PCAU sharing your contact details, preferred contact method and a summary of your calculation with one matched professional — a property or finance professional, such as a mortgage broker or buyer’s agent — so they can contact you about your enquiry, as described in our Privacy Policy. Professionals are matched on a national basis; we do not promise a professional in your local area.

These professionals are independent businesses. PCAU does not provide their services, does not supervise or endorse them, and is not a party to and is not responsible for any advice, service or transaction between you and a professional. If a professional takes up your enquiry, they retain access to the information shared with them, as explained in our Privacy Policy.

PCAU may receive a fee from the professional for connecting you. This is at no cost to you, and it does not change the information shown to you or our commitment to share your enquiry only where you have consented.

The Service and all of its contents and features are owned by Property Calculator Australia Pty Ltd or its licensors and are protected by Australian and international intellectual property laws. Except as expressly permitted in these Terms or by law, you may not copy, reproduce, modify, distribute or create derivative works from any part of the Service without our written permission.

8. Your suggestions

If you send us feedback, ideas or suggestions about the Service, you agree we may use them without restriction and without any obligation to you.

9. Third-party services and links

The Service may include or link to third-party content and services. We are not responsible for third-party services, including their accuracy, content or practices, and you use them at your own risk and subject to their own terms.

10. Disclaimers and consumer rights

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, and we do not warrant that it will be uninterrupted, error-free, secure or fit for any particular purpose. However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited (at our option) to resupplying the relevant service or paying the cost of resupply.

11. Limitation of liability

Subject to section 10, and to the extent permitted by law, Property Calculator Australia Pty Ltd and its suppliers are not liable for any indirect, special or consequential loss, or any loss of profit, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms. To the extent permitted by law, our total liability arising from the Service is limited to the amount you paid us (if any) for the relevant access in the twelve months before the claim.

12. Indemnity

You agree to reimburse Property Calculator Australia Pty Ltd for any loss or third-party claim to the extent it is caused by your misuse of the Service, your breach of these Terms, or your breach of the law or another person’s rights. You are not responsible for any loss to the extent we caused it. This clause does not limit any rights you have under the Australian Consumer Law.

13. Suspension and termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect users or the Service. On termination, your right to use the Service ends. Provisions that by their nature should survive (including intellectual property, disclaimers, liability and indemnity) continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. The current version is always available in the app and on our website, with the “last updated” date shown above. Where a change is material, we will take reasonable steps to notify you. If you continue to use the Service after a change takes effect, you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, and you and Property Calculator Australia Pty Ltd submit to the non-exclusive jurisdiction of the courts of New South Wales. If a dispute arises, you agree to contact us first so we can try to resolve it. Either party may seek urgent relief from a court where necessary.

16. General

If any part of these Terms is found to be unenforceable, the rest continues to apply. A failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us about the Service.

Part B
Additional terms for professionals

This Part applies in addition to Part A to any professional (“you”, “the Professional”) who registers for, or receives leads through, the PCAU marketplace. If there is any inconsistency for marketplace activity, this Part prevails over Part A.
